Rep. Ilhan Omar introduced the Make ICE Pay Act on September 17. The proposal would create a Department of Housing and Urban Development grant program and transfer $139,575,630,000 that Congress had previously appropriated to Immigration and Customs Enforcement and Customs and Border Protection. The measure is a bill, not enacted law.
The draft identifies Minnesota, California, Illinois, Louisiana, Maine, North Carolina and Oregon as eligible states. HUD would set grant criteria that must include lost economic activity, estimated costs to local governments and community harm tied to increased federal immigration-enforcement activity.
States receiving grants would have to transfer money to qualifying nonprofits and affected small businesses. Nonprofit uses could include support for schools, health care and psychosocial services, higher local-government operating costs, investigations, record-keeping and memorialization. The HUD inspector general would oversee the program, and the Government Accountability Office would study the operations’ costs.
Omar’s office said the legislation responds to named immigration operations in the seven states and described the total as nearly $140 billion. The draft would terminate the grant program three years after its establishment. Omar’s release listed six House co-sponsors, including Minnesota Rep. Angie Craig.
